AGREEMENT TO TERMS

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and The Nail Nook LLC, a Wisconsin limited liability company ("The Nail Nook," "we," "us," or "our"), regarding your use of our services.

By scheduling an appointment, receiving services, purchasing gift cards, or otherwise engaging with The Nail Nook, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

SERVICES

The Nail Nook provides nail care services including, but not limited to, manicures, pedicures, gel nail extensions, nail art, and related services ("Services"). All Services are performed by licensed nail technicians in accordance with Wisconsin state regulations.

We reserve the right to modify, discontinue, or change our service offerings, pricing, and availability at any time without prior notice.

APPOINTMENTS & SCHEDULING

Booking. Appointments may be scheduled online or by contacting us directly. A valid credit card is required to secure all online bookings. Your card information is stored securely and will only be charged in accordance with these Terms.

Confirmation. By completing a booking, you confirm that all information provided is accurate and that you agree to these Terms.

Timeliness. Please arrive on time for your scheduled appointment. If you anticipate being late, contact us as soon as possible. We will make reasonable efforts to accommodate late arrivals; however, if insufficient time remains to complete your scheduled service, we may need to reschedule your appointment, modify the service, or cancel. Late arrivals that result in cancellation or modification are subject to the Cancellation Policy set forth below.

SMS Terms & Conditions

When you opt in to text messages from The Nail Nook, you'll receive appointment confirmations, reminders, and occasional check-ins about your nail services. That's it. No spam, no sales pitches at 2am.

You can cancel anytime. Just text STOP to 608-234-4011. I'll send a confirmation that you've been unsubscribed, and you won't hear from me again via text. If you change your mind later, just opt back in through the booking process.

If something's not working right with texts, reply HELP for assistance, or reach out directly at [email protected].

Carriers aren't responsible for delayed or undelivered messages.

Standard message and data rates from your carrier may apply. You'll receive approximately 2-4 messages per appointment (confirmation, reminder, follow-up). Questions about your text or data plan? Contact your wireless provider.

CANCELLATION & NO-SHOW POLICY

We understand that circumstances change. Our cancellation policy is as follows:

More than 24 hours notice: You may cancel or reschedule your appointment at no charge.

Less than 24 hours notice: A cancellation fee of 50% of the scheduled service total will be charged to the card on file.

No-show: If you fail to appear for your scheduled appointment without notice, 100% of the scheduled service total will be charged to the card on file.

By providing your credit card information at the time of booking, you expressly authorize The Nail Nook to charge the applicable cancellation or no-show fee to your card in accordance with this policy.

We reserve the right to waive or modify cancellation fees at our sole discretion in extenuating circumstances.

Repeated cancellations, late cancellations, or no-shows may result in the requirement of a non-refundable deposit for future bookings or refusal of service.

PAYMENT

Payment Terms. Full payment is due at the time services are rendered. We accept cash, credit cards, and debit cards.

Pricing. All prices are subject to change without notice. The price in effect at the time of booking will apply to your appointment unless otherwise communicated.

Card on File. By booking online, you authorize us to store your credit card information securely and to charge applicable fees in accordance with these Terms, including cancellation fees, no-show fees, and service charges.

Declined Payments. If your payment method is declined, you remain responsible for the full amount owed. We reserve the right to pursue collection of any unpaid amounts and may refuse future services until the balance is paid in full.

GIFT CARDS

Gift cards are available for purchase and may be redeemed for any services offered by The Nail Nook.

Expiration. Gift cards are valid for twenty-four (24) months from the date of purchase. After this period, any remaining balance will be forfeited.

Non-refundable. Gift cards are non-refundable and may not be redeemed for cash, except where required by law.

Lost or Stolen. The Nail Nook is not responsible for lost, stolen, or damaged gift cards. Gift cards will not be replaced.

Non-transferable for Cash Value. Gift cards have no cash value and may only be applied toward services.

MINORS

Clients twelve (12) years of age and under must be accompanied by a parent or legal guardian for the duration of their appointment. The parent or guardian must remain on the premises and is responsible for the minor's behavior and safety.

By booking an appointment for a minor, the parent or guardian agrees to these Terms on behalf of the minor and assumes all responsibility and liability arising from the minor's appointment.

HEALTH, SAFETY & ALLERGIES

Disclosure. You are responsible for disclosing any known allergies, sensitivities, skin conditions, medical conditions, or medications that may affect your service prior to your appointment. This includes, but is not limited to, allergies to nail products, latex, fragrances, or other substances.

Products. We use professional-grade Ugly Duckling gel products that are 10-free, HEMA-free, vegan, and cruelty-free. Despite the high quality of our products, allergic reactions or sensitivities may still occur.

Assumption of Risk. By receiving services, you acknowledge and accept that there are inherent risks associated with nail services, including but not limited to allergic reactions, skin irritation, nail damage, or infection. You agree to assume all such risks and release The Nail Nook from any liability arising therefrom.

Right to Refuse Service. The Nail Nook reserves the right to refuse or discontinue service to any client at any time and for any reason, including but not limited to: visible signs of infection, fungal conditions, open wounds, contagious conditions, or any condition that may pose a health or safety risk to the client or service provider. No refund or compensation will be provided for services refused under this provision.

Sanitation. We adhere to all Wisconsin state sanitation and safety regulations. All tools are properly sanitized or disposed of between clients in accordance with applicable health codes.

PHOTO & MEDIA RELEASE

We may photograph or video record your nails during or after your service for use in our portfolio, website, social media accounts, advertising, or other promotional materials.

By receiving services, you grant The Nail Nook a perpetual, royalty-free, non-exclusive, worldwide license to use, reproduce, modify, publish, and display any photographs or videos of your nails for marketing, promotional, or educational purposes without compensation or further consent.

Opt-Out. If you do not wish to have your nails photographed, you must notify us at the beginning of your appointment. We will honor all opt-out requests; however, failure to notify us constitutes consent.

This release does not include photographs of your face or other identifying features without your explicit consent.

COMMUNICATION CONSENT

By providing your phone number and/or email address, you consent to receive appointment confirmations, reminders, follow-ups, promotional messages, and other communications from The Nail Nook via email, SMS, or other electronic means.

Opt-Out. You may opt out of promotional communications at any time by following the unsubscribe instructions or replying STOP to text messages. Opting out of promotional messages does not affect transactional communications related to your appointments.

INTELLECTUAL PROPERTY

All content, materials, designs, logos, trademarks, and other intellectual property displayed on our website, social media, or in our studio are the property of The Nail Nook LLC or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any of our intellectual property without our prior written consent.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY WISCONSIN LAW, THE NAIL NOOK, ITS OWNER, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

IN NO EVENT SHALL THE NAIL NOOK'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO YOUR USE OF SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE NAIL NOOK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

ASSUMPTION OF RISK & WAIVER

You acknowledge that nail services carry inherent risks, including but not limited to allergic reactions, skin irritation, nail damage, infection, and other adverse outcomes. By receiving services, you voluntarily assume all such risks, whether known or unknown, and agree to release, waive, and discharge The Nail Nook, its owner, employees, and agents from any and all claims, liabilities, damages, or causes of action arising from or related to your receipt of services.

This waiver is intended to be as broad and inclusive as permitted by Wisconsin law. If any portion is found to be invalid, the remaining provisions shall continue in full force and effect.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Nail Nook, its owner, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of any third party; (c) your use of our services; or (d) any misrepresentation made by you.

DISPUTE RESOLUTION

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles.

Informal Resolution. Before initiating any formal legal action, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. We will make good faith efforts to resolve any issue within thirty (30) days.

Jurisdiction. If informal resolution is unsuccessful, any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Dane County, Wisconsin. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Waiver of Class Action. To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and The Nail Nook regarding your use of our services and supersede all prior agreements, representations, and understandings.

MODIFICATIONS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last updated" date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically.
